Terms of use

HARMONY STUDIOS & CO PTY LTD Website & App Terms of Use Harmony Studios & Co Pty Ltd (ACN: 700 544 074) ("Harmony Studios", "we", "us", "our"). Last updated: [30 August 2026]. 1. Introduction These Terms of Use ("Terms") govern your access to and use of our websites and mobile applications, including our member portal and booking tools (together, the "Service"). Our Privacy Policy also applies and explains how we collect, use and protect your information. Together these make up the agreement between you and Harmony Studios & Co Pty Ltd ("Agreements"). Your use of our virtual office, registered office, mail handling, coworking and meeting‑room services is governed by our separate Terms & Conditions — Virtual Office & Address Services. These Terms of Use govern the Service (the website and apps) only. Where the two documents conflict in relation to a paid service, the services Terms & Conditions prevail. By accessing or using the Service you confirm you have read and understood the Agreements and agree to be bound by them. If you do not agree, you may not use the Service — but please contact us so we can try to help. 2. Communications When you create an account we may send you service and account messages that are necessary to operate the Service. We will only send you marketing or promotional messages where you have consented, and you can opt out at any time using the unsubscribe link or by contacting us. 3. Purchases If you buy any product or service through the Service (a "Purchase"), you may need to provide payment information such as your card details and billing address. You represent and warrant that (a) you are authorised to use the payment method, and (b) the information you provide is true, correct and complete. We use third‑party payment providers to process payments and complete Purchases, and by submitting your information you authorise us to share it with them for that purpose, subject to our Privacy Policy. We may refuse or cancel an order where there is a product or pricing error, an error in your order, suspected fraud, or an unauthorised or unlawful transaction. 4. Promotions Any competitions, giveaways or other promotions offered through the Service may be governed by separate rules. If you take part, please review those rules and our Privacy Policy. Where the promotion rules conflict with these Terms, the promotion rules apply to that promotion. 5. Plans & subscriptions Some parts of the Service are billed on a subscription basis ("Plan"). You are billed in advance on a recurring basis for each Plan period (daily, weekly, monthly or annual, as selected). A valid payment method is required, and you must give us accurate and complete billing information. By providing payment information you authorise us to charge the applicable Plan fees to that payment method. Unless you cancel, your Plan renews at the end of each period on the same terms. You can cancel renewal through your membership settings or by contacting our support team. If an automatic payment fails, you must pay the outstanding amount for the period as shown on your invoice. 6. Fee changes We may change Plan fees. Any change takes effect at the end of the current Plan period, and we will give you reasonable prior notice so you can cancel before it applies. Continuing to use the Service after a fee change takes effect means you accept the new fee. 7. Refunds Except where required by law — including where you are entitled to a remedy under the Australian Consumer Law — paid Plan fees are non‑refundable. 8. Your content The Service may let you post or share information, text, images or other material ("Content"), for example in a member or community feed. You are responsible for your Content, including its legality and appropriateness. By posting Content you represent that it is yours or you have the right to use it, and that it does not infringe anyone’s privacy, publicity, copyright, contract or other rights. You keep your rights in your Content. By posting it, you grant us a licence to use, host, store, reproduce, modify (for formatting), display and distribute that Content for the purpose of operating and providing the Service, including making it available to other users of the Service. We may, but need not, monitor or remove Content. Our own content within the Service is protected and may not be copied or reused for commercial purposes without our written permission. 9. Prohibited uses You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the Service in any way that breaches any applicable law or regulation; (b) exploit or harm, or attempt to exploit or harm, minors in any way, including by exposing them to inappropriate content; (c) send or procure the sending of unsolicited advertising or promotional material (spam); (d) impersonate or attempt to impersonate Harmony Studios, our staff, another user, or any other person or entity; (e) infringe the rights of others, or act in any way that is unlawful, threatening, fraudulent or harmful; (f) restrict or inhibit anyone’s use of the Service, or expose us or other users to liability; (g) use any robot, spider, scraper or other automated means to access or copy the Service without our written consent; (h) introduce viruses, trojans, worms or other malicious code, or otherwise interfere with the proper working of the Service; or (i) attempt to gain unauthorised access to, damage or disrupt the Service or any server or system connected to it, including by any denial‑of‑service attack. You can report objectionable content or any concern through the support section of the app or by contacting us. 10. Analytics We may use third‑party providers, such as Google Analytics, to help us understand how the Service is used. These providers may collect information as described in their own privacy terms; we encourage you to review them. We use this information to maintain and improve the Service, consistent with our Privacy Policy. 11. Accounts To create an account you must be at least 18 years old and provide information that is accurate, complete and current. Inaccurate or out‑of‑date information may lead to suspension or termination of your account. You are responsible for keeping your account credentials confidential and for all activity under your account, and you must notify us promptly of any suspected breach of security or unauthorised use. You must not use a name you are not entitled to use, or one that is offensive or obscene. We may refuse service, suspend or terminate accounts, or remove content where reasonably necessary, including for breach of these Terms. 12. Intellectual property The Service, and its content other than your Content, is owned by us or our licensors and is protected by copyright, trade mark and other laws. Our trade marks and branding may not be used in connection with any product or service without our prior written consent. 13. Feedback If you give us feedback, suggestions or ideas about the Service ("Feedback"), you agree we may use it without restriction or obligation to you, and you grant us a perpetual, irrevocable, royalty‑free, worldwide licence to use, modify and incorporate that Feedback into the Service. You are not obliged to give Feedback, and Feedback should not include confidential information. 14. Links to other websites The Service may contain links to third‑party websites or services we do not control. We are not responsible for their content, policies or practices, and we are not liable for any loss or damage arising from your use of them. We encourage you to read the terms and privacy policies of any third‑party site you visit. 15. Australian Consumer Law & warranties We provide the Service with due care and skill. To the extent permitted by law, the Service is provided on an "as is" and "as available" basis and we do not warrant that it will be uninterrupted, error‑free or free of harmful components. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are entitled to limit our liability for failure to comply with a consumer guarantee for services, our liability is limited (at our option) to resupplying the services or paying the cost of having them resupplied. 16. Limitation of liability To the extent permitted by law, we and our officers, employees and agents are not liable for any indirect, special, incidental or consequential loss arising out of or in connection with the Service or these Terms, however arising. To the extent permitted by law, and subject to section 15, our total liability to you is limited to the amount you paid us for the relevant product or service. This section does not exclude any liability that cannot be excluded under the Australian Consumer Law. 17. Indemnity To the extent permitted by law, you are responsible for, and agree to reimburse us for, loss we reasonably incur arising from your breach of these Terms or your unlawful or unauthorised use of the Service. This does not apply to the extent the loss was caused by us. 18. Termination We may suspend or terminate your account and access to the Service where you breach these Terms, or where reasonably necessary to protect the Service or other users, giving you notice where it is practical to do so. You may close your account at any time by contacting us or discontinuing use. Provisions that by their nature should survive termination — including intellectual property, disclaimers, indemnity and limitation of liability — survive. 19. Changes to the Service We may update, withdraw or restrict all or part of the Service from time to time. We will try to give notice of significant changes where practical, but we are not liable if the Service is unavailable at any time or for any period. 20. Changes to these Terms We may amend these Terms from time to time. Where a change is material, we will take reasonable steps to notify you (for example, by email or a notice in the Service) before it takes effect. Your continued use of the Service after a change takes effect means you accept the amended Terms. If you do not agree, you should stop using the Service. 21. Waiver & severability A failure or delay by us in exercising a right under these Terms is not a waiver of that right. If any provision is found to be invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions continue in full force. 22. Governing law & jurisdiction These Terms are governed by the laws of Queensland, Australia. You and we submit to the non‑exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them. 23. Acknowledgement By using the Service, you acknowledge that you have read these Terms of Use and agree to be bound by them. 24. Contact us For support, feedback or questions about these Terms, contact Harmony Studios & Co Pty Ltd at hello@harmonystudios.com.au or through the support section of the app.
